According to the Civil Code 2015, failure to return the money wrongly transferred is considered possession of someone else’s property without legal basis.
If the illegally seized amount of money is less than 10 million dong, the offender will be fined from 2 to 5 million dong (in accordance with point e, clause 2, article 15 of Decree 167/2013/ND-CP).
If the illegally seized amount of money exceeds VND 10 million, the offender can be prosecuted for criminal liability for the offense of illegally possessing goods as referred to in Article 176 of the Criminal Code 2015, as amended and supplemented in 2017.
