Apple is once again in trouble after a medical device developer filed a lawsuit against its Apple Watch Series 6’s pulse oximetry feature. Masimo claims that the giant iPhone maker’s wearable gadget bypasses some of its patents.

Jun Matsuda from Sydney shops for his new Apple Watch Series 6 at the Apple Store in George Street on September 18, 2020 in Sydney, Australia. Customers to the Apple stores in Australia are among some of the first in the world to be able to view Apple’s newest products. The new Apple Watch Series 6 features a blood oxygen sensor and app, while a new iPad (8th generation) has also been released.

Masimo is currently one of the largest medical-grade pulse oximeter manufacturers across the globe. Various hospitals and other medical companies use its medical gadgets. If you don’t know what a pulse oximeter is, it is a gadget that shows how much oxygen is in the blood of the user.

Experts and medical researchers use this advanced device to know the health factors affecting the patient’s oxygen levels. And now, Apple’s Watch Series 6 offers the technology as an internal feature.

Because of this, Masimo filed a complaint, asking FTC (Federal Trade Commission) to ban the device since its pulse oximeter feature infringes five patents of the company.

    Apple Vs. Masimo

According to Slash Gear’s latest report, Masimo filed a patent infringement against Apple Watch Series 6 before last month of June ended. The Federal Trade Commission is now investigating the lawsuit.

Specifically, Masimo asks FTC to complete stop the import of the Apple Watch Series 6. In the new lawsuit, Masimo accuses the giant tech developer of selling more Watch Series 6 units that bypass its pulse oximetry patents.

On the other hand, the patent office also suggested that Masimo needs to send the lawsuit to ITC (The International Trade Center). The office told this so that the lawsuit will not be delayed.

Aside from this, Masimo also claimed that the total ban of the Apple Watch Series 6 will not affect the public since this wearable is not really essential. The medical device manufacturer added that this gadget also doesn’t increase people’s welfare.

As of the moment, Apple Watch Series 6 is considered one of the most advanced oximeter devices since it can monitor your oxygen levels, even when you are sleeping.

Masimo Already Filed Other Lawsuits Against Apple

Mac Rumors reported that Masimo already reported Apple back in 2020. The medical gadget maker accused the iPhone maker of stealing trade secrets.

Aside from this, Masimo also claimed that Apple is misusing its innovations. Right now, U.S. Patent and Trademark Office is already investigating Masimo’s inventions since Apple disputed that it did not use its technologies.
